Apogee Software Ltd., better known as Duke Nukem creators 3D Realms, will now form part of Interceptor. 3D Realms will remain in tact and will act as a publisher of Duke Nukem: Mass Destruction while Interceptor will be doing the development work.
3D Realms co-founders Scott Miller and George Broussard, Nielsen said Miller will continue to work with 3D Realms as a “creative consultant”. Miller is thought to have been heavily involved in Duke Nukem: Mass Destruction. The new Duke Nukem title is at the centre of an ongoing lawsuit with Gearbox, who took on finalising development of Duke Nukem Forever, which claims, “Interceptor’s new game ‘Duke Nukem: Mass Destruction’ will make unlawful use of Gearbox’s IP, including characters, marks, and copyrights in violation of Gearbox’s rights under the APA, and federal trademark and copyright law.”
